Welcome to Playupi. These Terms and Conditions ("Terms") govern your access to and use of the Playupi website and services (collectively, "the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. About the Service

Playupi is an online platform that provides free access to browser-based games ("Games"). Games are provided by Playupi or by third-party developers and publishers. The Service is operated by Playupi.

2. Eligibility

Third-party Games remain the property of their respective developers and publishers. The appearance of third-party Games on the Service does not transfer any ownership rights to Playupi or to you.

The Playupi name, logo, and all related trademarks are the property of Playupi. You may not use these marks without prior written consent.

6. Third-Party Games and Content

The Service hosts Games created by third-party developers. Playupi does not control and is not responsible for the content, functionality, or behavior of third-party Games. Each Game may be subject to additional terms imposed by its developer.

Third-party Games run in a sandboxed environment within your browser. However, Playupi makes no guarantees about the behavior of third-party code beyond reasonable review efforts.

The Service may contain links to third-party websites or services. These links are provided for convenience only. Playupi does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites or services.

8. Advertising

The Service is funded through advertising. By using the Service, you acknowledge that advertisements may be displayed before, during, or alongside Games and content. Ad content is provided by third-party advertising networks and Playupi does not control the specific ads shown to you. You may manage your advertising preferences through the consent management tools available on the Service.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

10. Disclaimer of Warranties

Playupi does not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will be free from viruses or other harmful components

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Playupi AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL Playupi'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED ONE HUNDRED EUROS (EUR 100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Playupi and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

Playupi reserves the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. Games may be added, removed, or modified at any time. Playupi shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of France. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France.

17. Severability
